Superior Court Judge, Jennifer Forbes, rules to dismiss complaint against other lawyers.

Kitsap Superior Court Jennifer Forbes refused to disqualify herself under law, see RCW 2.28.030(1) and refused to recuse herself under law, see RCW 4.12.050, so she could use a court rule, 12(b)(6) motion to dismiss, a case against lawyers, Felice Congalton, Associate Director of the WSBA and J. Reiko Callner, Executive Director of the Commission on Judicial Conduct. Read the complaint at this link Cause quo warranto v Callner Congalton (1)-signed

What is even more absurd is that the lawsuit was to be heard by Judge Mills, but was transferred to Judge Forbes for unknown reasons. Judge Forbes and I have had major disagreements over her character when Forbes was candidate for the judicial seat. In fact, here is a link to a story published June 2013 Jennifer Forbes, citizens beware!

Given this clear conflict of interest there is no need to try to understand Forbes’ logic in reaching her decision to dismiss a lawsuit filed by me against two fellow attorneys who belong to the ‘regulatory agency’ that oversees the conduct of attorneys and judges.

WA State Supreme Court as made it clear in the case, WA State Labor Counsel v Reed 149 Wn.2d 48, 64 (2003)

“To permit branches to measure their own authority would quickly subvert the principle that state governments, while governments of general powers, must govern by the consent of the people as expressed by the constitution.”

Clearly Forbes believes this is meant only for the other two branches.

I’m not personally familiar with this judge in particular, but in general it does seem logical based upon my own experiences, as well as the general chatter of the legal profession about how judges can differ, to think that some judges are more in need of accumulating an unusually large stack of get-out-of-judicial-misconduct-accusations passes than others. One cannot help but wonder whether that plays a role here.

  2. I am so sorry to here this. Everybody that has been to court realizes that it is the largest scam against them, we just need to pull these people of the general public together and raise up in our wrath against these monsters that refuse to uphold the law and steal are families, children, and belongings.

    • Yes, this is happening all across the country, people are learning just how corrupt the “legal establishments” has made our “courts.” I spoke with Sergeant Jim McDonough of the Kitsap County Sheriff’s office about this very reality and how it is leading to a very possible, and equally possible bloody, revolt. I asked that he get “involved NOW” in helping me in my “civilized approach” to release the complete monopoly the legal establishment has on our justice system. The Sergeant agreed with me in all that I said and also agreed it may lead to a likely revolt, but said he is too scared to do anything about it because what ever he can do must go through the very “legal establishment” that is defrauding us.

      Said another way, the “legal establishment” has become OUR GOVERNMENT, AND IT IS AN OPPRESSIVE REGIME. The legal establishment of lawyers and Bar Associations who have ‘ruined our trust in government.’

The other obvious thing I have to wonder about is whether Ms. Forbes is already a member of the Committee, or whether she will become a member of such once Mr. Penoyer’s evident resignation is effective in a couple weeks, i.e. whether it will turn out that she is his replacement on the Committee. That would unfortunately be consistent with some of our experiences in the past and be typically scandalous if it had been already arranged but concealed at the time of this ruling. Normally one does not expect this type of thing, but after you get a whiff of how things really work there…
